Comment:2nd Floor ; DNREC - Solid & Hazardous Waste Management Section LEGAL NOTICE OF PUBLIC HEARING Delaware Solid Waste Authority (DSWA) Cherry Island Landfill Permit Modification The Department of Natural Resources and Environmental Control (DNREC) has received a request to hold a public hearing regarding modifications proposed to the DSWAâ€™s Cherry Island Landfill (CIL) operating permit, SW-06/01. Proposed modifications included a request by the CIL Citizens Advisory Board (CAB) whose members, on December 16, 2010, requested a permit amendment to reduce CAB meetings from quarterly to three times per year. Update: On April 15, 2013, the CAB voted to continue meeting four times per year and as a result, that part of the proposed permit modification will be withdrawn. The CAB will continue to meet quarterly, as specified in the current permit. Other modifications include revisions to the DSWAâ€™s geotechnical monitoring plan as proposed by DSWA December 9, 2011. DNREC has also chosen to include other minor and administrative revisions of the permit as part of this modification process including an updated landfill gas migration monitoring plan, an updated environmental monitoring plan, and changes to reporting procedures that will include more explicit permit conditions for electronic reporting of environmental monitoring data. DNREC is also proposing enhancements to stormwater monitoring required by the permit. DNREC also plans to relax the permit condition that currently requires CAB members live within 5 miles of the CIL. The permit modifications do not extend the expiration date of the landfill permit or increase the size of the landfill. The DSWA Cherry Island Landfill is located at 1706 E. 12th Street, Wilmington. The public hearing will be held in the 2nd Floor Auditorium (mezzanine level) of the Carvel State Office Building at 820 N. French Street, Wilmington, DE 19801, beginning at 6:00 PM on May 30, 2013. If you are unable to attend the public hearing and/or prefer to submit written comments, then provide your comments to DNREC by noon on May 30, 2013 to ensure that they are included in the public record at the hearing. Upon completion of the public participation process and if the Secretary finds that issuance of all or part of the requested modifications are warranted, DNREC shall issue an amended permit which takes into consideration public comment.
