DNREC determined that satisfactory progress was not being made at the site. DNREC then requested that Mr. Cruz begin negotiations for a Consent Decree to conduct the RI/FS and/or Remedial Action. On July 25, 2012, DNREC sent a notice of enforcement proceedings to Mr. Cruz allowing him until August 2, 2012 to sign a Consent Decree or proceed through enforcement. Mr. Cruz responded that he was willing to negotiate with DNREC in late August 2012, but has since failed to proceed with negotiations. Therefore, DNREC will continue with an enforcement action unless the Consent Decree is signed, pursuant to Â§9109(a)(3) of HSCA, to require a remediation of the site.
