By February 2012, DNREC determined that satisfactory progress was not being made at the Site and terminated the VCP Agreement. DNREC originally advertised that the public hearing would be held on March 19, 2014, but was recently contacted by the Site ownerâ€™s counsel to negotiate a Consent Decree to address the performance and payment for a Remedial Investigation/ Feasibility Study (RI/FS) to be performed at the Site without the need for an enforcement action. DNREC agreed to postpone the public hearing to allow enough time to negotiate a Consent Decree. However, DNREC will continue to proceed through an enforcement action at a public hearing on May 7, 2014 unless the Consent Decree is signed beforehand.
