WHEREAS, The Delaware Department of Transportation, (DelDOT) has custody and control of an unimproved portion of Climax Avenue, Wilmont Subdivision, Wilmington, Delaware and New Castle County; and WHEREAS, the adjoining property owners, have petitioned DelDOT to consider the vacation and abandonment of an unimproved portion of Climax Avenue, measuring approximately 92 linear feet +/-, which has ceased to be of necessity to the highway system.
WHEREAS, Title 17, Section 1311 of the Delaware Code grants DelDOT the authority to vacate and abandon public roads or parts thereof, ceasing to be of necessity to the general highway system. NOW, THEREFORE, BE IT RESOLVED by DelDOT that a Public Hearing shall be held with regard to the proposed vacation and abandonment of an unimproved portion of Climax Avenue. The hearing will be held at the Brandywine Hundred Library, Conference Room, located at 1300 Foulk Road Wilmington, on Tuesday, September 11, 2018 5pm.
