On 8/29/16, EPA finalized 2 rules applicable to MSWLs. EPA finalized 40 CFR Part 60 Sub XXX, which regulated the emissions of new MSWLs. EPA finalized 40 CFR Part 60 Sub Cf, which mandated states to develop plans to regulate emissions of existing MSWLs. The purpose of this action is to incorporate the requirements in Sub XXX by reference as Sect. 30 of Reg. 1120 and to satisfy the existing requirements of Sub Cf by expanding the applicability of Sect. 30 to include existing & new MSWLs.

On October 25, 2016, a Partial Consent Decree was finalized between the United States Justice Department, the Volkswagen (VW) Corporation, and its subsidiaries regarding the installation and use of emissions testing defeat devices in over 500,000 vehicles sold and operated in the United States beginning in 2009. Use of these defeat devices has increased air emissions of nitrogen oxide (NOX), resulting in adverse impacts to air quality and violating the federal Clean Air Act.

The facility will consist of five 10 MW and five 2.5 MW natural gas fired reciprocating engines. MTC has proposed to control emissions from the engines using Selective Catalytic Reduction (“SCR”) and oxidation catalysts (“OxyCat”) . These air contaminant control devices will reduce emissions from the engines generated from the combustion of natural gas. The project will also contain a counter flow cooling tower. Purpose of the revision - change monitoring compliance of Reg. 1131 by Delaware registered vehicles. DNREC performs parking lot surveys, recording expired vehicles registrations and they are put in the I/M SIP to track compliance and are made part of the annual I/M report to EPA. Hearing on application submitted by Delaware City Refining Company (DCRC) to amend its Unit 15 Marine Vapor Recovery (MVR) System to allow for the capture and control of displaced vapors occurring during loading of crude oil from existing Piers 2 and 3 at the Delaware City refinery located at 4550 Wrangle Hill Road, Delaware City, DE 19706. The proposed amendment will allow DCRC to ship 45,000 barrels per day crude oil from its marine piers to the PBF Paulsboro, New Jersey Refinery.

DAQ proposes to lower sulfur content in residual fuel from 10,000 ppm to 5,000 ppm, in distillate fuel from 3,000 ppm to 15 ppm, and to set up a compliance date of July 1, 2016. DAQ also proposes to add necessary recordkeeping and reporting requirements to ensure compliance of the regulation. DAQ proposes that the new limits apply to all three counties in Delaware.

On June 2, 2010, EPA strengthened the NAAQS for SO2, by adding a new standard of 75 parts per billion. Sections 110(a) and Section 110(a)(2) of the CAA require States to submit to the EPA Administrator a SIP that provides for implementation, maintenance, and enforcement of a newly promulgated or revised NAAQS. The proposed SIP document discusses how meets each requirement of Section 110(a)(2)(A)-(M) of the CAA for the 2010 SO2 NAAQS.

The proposed amendments require that petroleum refinery units purchase CO2 allowances to cover its reported emissions each year that are directly associated with the electricity generated and exported to the electrical grid. Petroleum refinery units participating in the CO2 Budget Trading Program will be required to report emissions, as required by other Electric Generating Units, and accept enforceable permit conditions.

Application submitted by Delaware City Refining Company to restart the Unit 34 Olefins Plant (aka the Olefins Restart Project) which has been out of service since May 2001. As a result of the Olefins Restart Project, a 35 mmBtu/hour existing heater (134-H-101) will be restarted and 3 product storage tanks (580-TF-10, 582-TF-4 and 583-TF-4) and a feed surge drum (43-D-204) will be returned to service. Product olefins will be loaded into trucks using the existing methanol unit loading rack.

Hearing on air permit application submitted by Delaware City Refining Company (DCRC) to restart the Unit 33 Ether Plant Cooling Tower which has been out of service since 2002. The application states this cooling tower has a design water circulation rate of 30,000 gallons per minute and will result in annual air emissions increases of 5.5 tons of volatile organic compounds and 1.7 tons of particulate matter.

This revision is to reduce the allowable content of sulfur in fuel oils being combusted in all three counties in Delaware and to extend the maximum sulfur in fuel requirement, currently applicable to New Castle County, statewide. Use of fuel oils with lower sulfur contents will effectively reduce emissions of sulfur dioxide (SO2). The reductions will also reduce acid rain and fine particulate matter and aid in reaching visibility goals of the federal regional haze program.
